Changing non-imm B to non-O based on marriage

Post by Procyon »

This year I will need to change my visa status from working to marriage, has anyone done this recently at Hua Hin immigration?

I ask as I'm getting so many conflicting stories about the requirements and the hassles people get there (even if they have all the legal requirements). Rejections because the account has no recent transactions, rejections because they didn't like the map/photos (house number not clear), rejections because it was the "wrong bank", rejections because the amphur letter wasn't recent enough ... and on and on ...

Is the list here still accurate? viewtopic.php?f=9&t=23918&start=36

I have the 400k in the bank for 3 months, does the account need to be at a specific bank, and does it need to be used (regular transactions)? Though I dont see how if it cant go below 400k.

How recent can the amphur office marriage approval be and does this need to be at the same amphur office where the marriage cert was issued? How recent does the bank letter need to be? I only ask these as I dont actually live in HH but my local immigration (Dansinkon) wont do marriage visas.

I get the feeling it will be easier just to bugger off to Cambodia and get the visa there but I at least want to try it here first.

I don't think that the money has to be in any specific bank. It just needs to be in an account that you have immediate access to.
When you apply the first time, I don't think there has to be any activity on the account. However, in future years Imm will probably want to see activity and that you top the account back up in time. Any topping up of funds will have to be seen coming from abroad. If you've got to season the money then you'll need more than 400K to live off in the months before reapplying.
I've never got the marriage approval but I would assume that the records will be kept in the amphur where you got married.
Your bank letter should be issued as close to application date as you can get it. Make sure the amount tallies with your bank book.
As you'll probably know, the marriage extension is granted in BKK. HH will only process the application.
As far as I can see, the thread you've linked to seems accurate. Remember to take the missus along.

Do they check the source of the funds then? Surely if you've worked here and paid tax you can use savings?

Has anyone actually done this visa change in Hua Hin?

For the first extension, I don't see that savings from your work would pose a problem. However, I'm not sure how they'd be viewed in subsequent years.

I am actually in the process of doing this now, my work visa is cancelled and I am on the 30 day extension 'under consideration' while the paperwork is in Bangkok.

Contrary to advise I was given on the Thaivisa forum I did not have to leave the country.

However ... the bottom line is that it would have been virtually impossible to try to attempt this alone. I spoke to three different people in immigration and was given three different answers on the requirements, nobody seemed to know and I got the impression they simply did not want to do it. They only seem happy doing 90 days and retirement extensions which are quick and easy.

So, I had to get some help.

I contacted the visa agent that sponsors this forum and they had contact with someone in immigration that has a bit of authority. The wheels were set in motion and I was given a list of requirements.

Essentially it is the full list for the marriage extension posted here: viewtopic.php?f=9&t=23918&start=36 , plus a letter from my company stating I no longer worked there and my child's birth certificate.

Everything needed copying in triplicate and it took two hours in immigration with a prior appointment. The officer I dealt with was quite sympathetic and stated that there are more papers to complete every year, I had two new forms that I had never seen before.

When all was complete he asked me why I didn't apply for a marriage extension, dumbfounded I replied that I thought this is what we were doing ?! No witnesses he said, you have child support visa instead. They called me at home a couple of days later and wanted more photos of us standing outside the house (I'd already supplied 5), these we could email.

So now it is in process and I need to wait until it returns from Bangkok in a few weeks, I did not have to leave the country. I could not have done it with out the Hua Hin Visa Service so a big plug for them is in order. If you have any visa complications or problems with immigration contact them for help: http://huahinvisaservice.com/
