Using a house as a business address.

I have a house which for legal reasons (Thai law obviously) is, on paper anyway, rented to me.

I then rent it out to a Scandinavian guy and his Thai g/f who work for some property development company I believe.

He want to use my house as a company address. I have initially said no but what would be any legal or problematic issues if he did ?

What might be an important question: does he have a workpermit or does he want to apply for one on this adress? If yes, he will need to show a rental contract and this brings you in the official circuit also. Might have some (tax-)consequenses. Talking about tax: I had a business before in a rented place, and because of this, the owner had to pay 1,5 month rent to (i think) the tessaban here in town, but in our contract was a clause that i had to pay this. Hopefully somebody else has got more info on this.

I'm pretty sure its for tax purposes, the tax bills for the company and tax ID will be registered at that address so the person liable may well be the owner of the property, not the MD of the company. If the company folds or they don't pay they'll still chase the tax at the registered address - your house.

Most Thai landlords don't take too kindly to businesses being setup in their houses so I'd take a leaf out of their book just to be on the safe side.

Thanks for the replies guys.

The tenant met my lawyer when we was doing all the paperwork for the house and he then asked her to do some work for him and it is her who has suggested to use my house but I refused as I do not know the consequences in Thai law.

It's a pity as they are good tenants and as their 6 month rental contract expires next month they are going to Sweden for 3 months and would have paid the rent in advance for the 3 months then wanted to rent for another 5 months on their return.

So anyone want to rent a new 2 bed, 2 bath bungalow on Soi 88 ? :thumb:

What monthly rate is it ? I have a friend that maybe moving to Hua Hin

I'll be looking to rent for a couple of months as well Pagey. Soi 88 would be great, but I'm afraid it won't be until Jan/Feb. time and I can't yet give exact dates.
I'm sure you won't have any trouble renting it out very soon, but if it comes vacant again please let us know. :cheers:
