Following the start of a major awareness campaign amongst the expat population of Hua Hin regarding property disputes, there are now a substantial number of cases waiting to be heard by the Hua Hin Conciliatory Committee, which is presided over by Khun Tuck Dechapanya.
There are instances in town of disputes arising between purchasers of property and developers. In many cases, the buyers are complaining that title deeds are not being released to them, despite monies being paid. Khun Tuck is now acting as mediator between the parties who, most of the time will be foreigners.
Only a few days ago, the Hua Hin Court postponed a civil action that could have dragged on for years and instead let the Conciliatory Committee try to forge resolution. In another case, buyers who had parted with the full purchase price for their property three and a half years before, were still waiting for the title deeds from the developer. Khun Tuck intervened and the deeds have now been handed over.
Another case involved purchasers who were unhappy with a leaking roof. The developer was allegedly unwilling or unable to rectify this and other defects. The Conciliatory Committee managed to negotiate a settlement whereby the developer is building the purchasers a new home.
Prachuabkirikhan's Vice Governor, Khun Sanit Boonkohsakul has warned that any foreigners running a property business will be investigated by the government if they do not comply with Thai law. Any guilty parties will have their Work Permits and visas revoked. Khun Tuck has further advised that any foreigner thinking about buying land or a house in the Hua Hin area should contact The Hua Hin Foreigner Service Link Centre before signing any contract, so the situation can be discussed with the relevant government officer. By so doing, it is hoped that any future disputes can be avoided.
