Property development Juristic Entity

Post by terry+carmen »

Last night the residents at Emerald Resort voted to set up a Juristic Entity. There is some confusion about start dates. The developer has just completed the club house and it has been suggested that we wait for one year because the club house will be under guarantee for that period. The last houses are due to be completed by December this year. I have read in another post that when 50% of houses (no mention of a club house) have been completed the residents can form a Juristic Entity. Has anyone had experience of this procedure?

Still trying to go through it on the development on which I have a house. Taken over a year and seem to be getting nowhere! You can apply for Juristic Entity after a certain percentage of the home have been sold,60% I think, but what seemed a straight forward process is turning into a minefield. You need a very determined committee.
Guarantee of club house has no bearing on the process.
Good Luck

Under resort owners committee you'll find some information to your query.

The HEIGHTS development up the hill to Elephant Village has been a successful Juristic Entity for some years. I last heard that their committee had appointed Room to Room to manage so they may be able to give you committee names.

Juristic Person: the Heights does have a Juristic Person status. The former resident and our first chairman who did most of the work in setting it up has sold his home a few years ago and left.

I do remember that as long as we followed all the steps to the letter, it did seem to go well.
I agree that RoombyRoom David Nears might have more information about it than the current chairman does. As the current Chairman was not involved in setting up the Juristic person he may not have much information.

good luck, it is well worth the effort to set it up as you have no developer coming up with surprises for the residents.
