I'm not arguing for arguing's sake. And it's not my opinion. Just stating a fact. I've read every act in thailand from building regulations to the 'Lawyers Act'. There was a reason that I had to but that's got nothing to do with the current debate. The facts are clear. One thing that comes to mind where some posters have lost out. The judge has some leeway depending upon the reason for the divorce. If there is a 'wronged' party, i.e. adultary, abuse, etc, then the judge can award compensation to the wronged party. That compensation is at the discretion of the court (i.e. the judge). He or she can award the house, for example, as compensation. If the divorce was for adultery then he/she can award damages against 'the perpetrator', normally no more than 2 million. It has happened and will happen again.

Yes, you are - we know how Thailand and its bureaucrats really enjoy abiding by laws and legal code - what you state may well be the law as it is written but common sense and life here is often the complete opposite, anyone that cant grasp this simple premise may as well give up. Law here is a mess, I know from my early years selling houses...many people were wronged by a few developers and got nothing...where is the justice there..backhanders by developers did the work.
Thankfully those developers who dont finish homes are now very few and everyone knows who they are... if they choose to sell for them its a joke.

The other problem about buying a house in Hua Hin are the 'so called' Estate Agents - ask them if they have any qualifications ie surveyor, valuer etc etc - their interest is the large 5% fee. Sorry if any have appropriate qualifications, please say.
Prior Planning & Preparation Prevents Piss Poor Performance.

Simple answer is do NOT buy a house in Thailand, they are very difficult to sell later and the values rarely increase. Plus all the hassles mentioned in previous posts.

i agree 10% with stevepiraq. look to rent for a long enough time to see all the pit falls and problems before you make that decision to buy.

It depends if you view a house as an investment or a home. Also how long you are likely to stay. I was speaking to a man recently who has been renting a house for 12 years ! My personal view on house purchase here is that you should be able to stand losing 50% of the purchase price if things don't work out. I have bought mainly as I like to have my home arranged as I like it. Possibly daft I know.

I live In France And bought 2 apprts condo un Miracle project ( face to Palm hills golf) but the project delayed more than 1.5 years... Is there anyone who is aware about this project for advise ?
By the way, with the Booming lately In hua Hin, is there any impact on tourists and foreigners daily life ?

I agree with quite a few comments. JW is right that 12/14 years ago there were some very sketchy developers. All have been identified and a simple google bit of homework will reveal who you are dealing with. Also agree with musungu that there are some estate agents that do not have in depth product knowledge to the level of an architect, engineer, surveyor; do either not know the property laws or blatantly lie about them. However they are in the minority.
My company, as well as selective brokerage, designs and builds properties using our team of architects, engineers and qualified, experienced tradespeople. Our staff assist with all aspects of any works, purchases or rentals , dealing with govt departments etc right up until you are relaxing in your pool with a gin & tonic and beyond.
Now if that makes us a "So called" estate agent then I guess that is what we are

After living here for the last 2 years, and coming to Thailand for the last 20 years, i believe its like buying property anywhere, its all about location, infrastructure etc. Straying away from houses for a moment, we bought a small condo off plan in Takiab 2 and a half years ago, and sold it just after completion for 20% profit ( the exchange rate was also favourable which made it quite a nice gain) I have been watching condo prices over the last 4 or 5 years in Hua Hin/Takiab area, and bht/sqm seems to go up every year not down as everyone seems to be indicating.
Some people would prefer to pay rent for 5 or 10 years, which seems to be a waste of money if you plan on staying here long term. You never own the place which to some is beneficial, but you cant really make any changes as well without consulting the owner, so its not like its your own home.
I had a a good friend tell me 8 years ago NOT to invest in the Sydney property market, as it was about to crash heavily, all doom and gloom. Needles to say i ignored his plea and invested in a few properties which have now enabled me to live a comfortable and quiet lifestyle here in Takiab.
Each to their own i guess, but as long as you do your research, and are a careful with your decision, it can work for you not against you.
