Late for 90 day reporting

Post by robby hh »

It would seem I have somehow misscalculated my 90 day reporting date and am acouple of weeks over.

Read somewhere that there is a dayly fine for this but cant find where I read it.

Anyone know anything about this or what I am likely to encounter at BKK office?

I've been a few days late before with no problems (at the Hua Hin office). Two weeks may incur a fine but better to go and get it sorted out as soon as possible than to wait until the fine grows if there is one.

You can report 7 days early, or 7 days late with no problems as the law is written. After that ? Pete

As Pete says, here the link to the leeway given for 90 day reporting:
http://www.immigration.go.th/nov2004/en ... age=90days

This next bit's a bit cumbersome, but follow the link and look at sections 37 and then 76:
http://www.immigration.go.th/nov2004/en ... on_Act.pdf

Hope that prepares the OP for what could happen.

I was in a similar situation and got fined a flat fee or 2,000 baht (HH imm). This was a couple of years ago so it may have increased since then, or BKK may have more leeway with it.

I have seen it in writing on a Thai Immigration site but I forget which one.

I was always fined 200Baht per day. You used to get one day without penalty at Don Muang to allow for post midnight flights.

It went up to 500 Baht per day a couple of years ago. I have always been fined although always is only four or five times. On one occasion at Ranong the officer got a bit shitty with me and pointed to the sign stating that I could be imprisoned. That was despite the fact I was fully prepared to pay and had apologized for my error and only a couple of days.

Hi all

Went to BKK immigration yesterday and presented the completed form and was told you have not reported on the correct date so there will be a fine of 2000b. The gent in front of we had the same problem and also a fine of 2000b , seems there is a flat fine no matter how long the non reporting period is.

The date they gave me as to when I should have reported was in May, I know I have done a 90 day report since then and also renewed my visa so I have no idea where they got that date. It bears no relationship to either when I last entered the country of when I renewd my visa.

I pointed out that it was less than 90 days since I had renewed my visa and was told a visa renewal does not constitute or replace a 90 day report but if you tell them when you renew that you want to have a 90 day report at the same time they can do that.

I now have a paper, the bottom part of the form, in my passport with the next reporting date so I should have no more problems.

Hope that helps someone.

Isn`t this typical Thai "logic"? "If you tell us, then we can do it"????

And if they told you that the 90 days does not start from the day you enter the country, they are wrong. It is also just another example of individual officers interpretation of the regulations. My last renewal in Hua Hin was the 20th October 08, and they have entered 17th January 09 as the next reporting date--no mention of asking what date I would like!

I'm a bit confused when you say you renewed your visa. If you mean you extended again for another year, then I think Imm have unfortunately got it right. You still have to report within 7 days before or after the date you would have been given prior to the new extension, but as you say, Imm may be persuaded to count your renewal as a report.
If you actually left the country to get another visa (and I don't think this was the case), then you probably never stayed for more than 90 continuous days, so there was never any need to report. The 90 day clock is reset from the day you re-enter Thailand.
However, as Nereus says, individual officers can and do interpret things differently.

BTW, Guess. I meant to post regarding your's above. You're talking about overstay, not being late for reporting.

Yes Lonu I extended at HH for another, as it turned out for 6 months as I had problems with HH immigration detailed in another post.

The date they said I should have posted bore no relationship to the date I last entered the country, 2 weeks in Cambodia.

I learnt long ago to walk away from futile arguments so paid up and shut up.

Another thing, you are made to sign a police form that says you have been a naughty boy so it looks like I now have a police record.
