I think it isn't a change of subject...it just underline, why the circumvent of land-law (by using a company) is under investigation now.
TTM is true...if TH would like to have farangs as owners of land & house they simply change the law.
It's easy, isn't it?

You put fear and concern into many on here.
In fact another couple came to my house today and the same as your friends, my advice.
Contact their Embassy for advice about purchase or contact a good lawyer in Bangkok for real advice.
Please dont hold your breath as it may affect your good health.
Maybe now you would like to enlighten the board of your interest in this subject.

I believe that if they have the company information . I.e. name and date of creation that the company is then uniquely identified in Thailand. When I set up my company I had to go through four or five choices before I found one that was unique. Once they have that they will be able to obtain all VAT and income records from the receiver this way ellimintaing the risk of being shown false forged documentation. There are some positive signs that he Thai Government agencies are beginning to get a grip of 20th century mehods used elsewhere.Burger wrote: 1. However the only shareholder documentation that they ask to see is 1 of the above 3, ie: recent bank statements at time of company formation.
Copies of shareholder bank statements are already taken by solicitors who set our companies up and filed.
They do not request salary slips, proof of income tax payments, loan details etc etc.

Now let me post the full content of what i wrote and not the edited edition.
It was an axplaination of the fact that a farang can not own land and that the company route will be looked into. if it is found that a company was formed only for the purpose of buying land then they can seize the property pending a court case. It will then be for the courts to decide if and how much you may recieve from the sale of your land.
And of course the letter.

''We have learned that Thais have acted as nominees for foreign investors to avoid compliance with the Foreign Business Law, which limited foreign stakes at 49%. Tighter requirements [for proving] one's financial status will help us sort out this problem.''
Companies violating the rules would face dissolution. Complicit shareholders also could face fines of up to one million baht and/or jail terms of up to three years.
In the future, the Business Development Department plans to examine existing registered companies with foreign shareholders to determine whether they breach the new rules or not.
I think i would prefer option 1.

I am in no way involved in property and have no wish to be, and i still stress, before anyone considers buying at this time talk to one of the Lawyers i posted earlier.
If as you say all is ok then i really cant see why you would have any problem with this.

You also forget who was using the 15th May Ministry of Interior Statement to support their opinion and it wasn't me.

On & on & on we go, yes boring the t*** off of everybody but it is a serious subject. Because a very rich Thai politician along with the Singapore government cheated this government the rest of the politicians want to save face so they have introduced a spoiler so that nobody looks at the Shin Corp deal. How the Thai government can associate private individuals buying houses with the likes of Shin Corp I do not know, but they have acheived what they wanted. Everyone is looking at all the web sites and reading this, that and the other and not loooking at the reports, if you can find them, of the big deals, the ones completed by the Rich Thai families and brushed under the carpet. Now I understand that the Thai government are desperate to join the WTO. I am given to understand that to join the WTO, applicant countries must remove all restrictions on foreign ownership, land, companies w,h,y. So my guess is in a few years time all will come right. Take a look at the recent HSBC investment here. My advice, sit back, enjoy the sun the sea and the Singha, TTM and Burger are taking all the stress so why should we worry.
