Tycoon Premchai's jail term increased in black-leopard case

KANCHANABURI: The Appeal Court on Thursday increased the prison sentence handed down to construction tycoon Premchai Karnasuta to three years and two months for illegal possession of a dead pheasant and firearms in a national park, and supporting poaching.

The president of Italian-Thai Development Plc and three accomplices were arrested at their unauthorised camp in the western Thungyai Naresuan Wildlife Sanctuary in Thong Pha Phum district on Feb 4, 2018.

Firearms, ammunition and the carcasses of a rare black leopard, a pheasant and a barking deer were found near them.
The ruling of the Court of Appeal Region 7 was read out at the Thong Pha Phum Court on Thursday, beginning at 9.30am.

It took about an hour. Mr Premchai, 64, and his three co-defendants were present.

Mr Premchai's sentence was increased from the 16 months laid down by the Thong Pha Phum Court in March to three years and two months. His driver, Yong Dodkruea, 66, was sentenced to three years and five months - an increase from one year and one month.

His maid, Nathee Riamsaen, 44, was sentenced to one year and eight months, up from a suspended four-month term, and his hunter, Thanee Thummat, 57, who was found guilty of killing the black leopard, now faces three years and nine months in prison, up from three years and five months.

The Appeal Court upheld the first court's order for them to pay 2 million baht in compensation for damage to natural resources to the Department of National Parks, Wildlife and Plant Conservation.

It released the four defendants on conditional bail pending further appeal to the Supreme Court. The bail bond was increased by 200,000 baht each from the previous 400,000-500,000 baht. They were prohibited from leaving the country without getting prior court approval.

I don't understand this "increase in sentence". I'm not speaking about this particular case, but any case. You have a right to appeal but it appears a deterrent is in place to discourage people from exercising that right.

Any other country in the world inflict this scare tactic penalty upon their citizens?

Despite claims to the contrary, my experience of the court system here is it is similar to the immigration system.
All depends on which judge is presiding, and whom it is being sentenced. With ongoing cases it is never the same judge presiding, regardless of which court it is.

KANCHANABURI: Construction tycoon Premchai Karnasuta ended up spending last night behind bars at the Thong Pha Phum prison after the Appeal Court slapped him with a sentence of more than three years for the illegal possession of a protected animal, carrying firearms in public and supporting poaching.

The president of Italian-Thai Development Plc and two of his accomplices filed for bail on Thursday, but the court decision was not released in time. :lach:

Premchai bailed, tagged, released

KANCHANABURI: Italian-Thai Development president Premchai Karnasutra and two co-defendants were granted conditional bail by the Supreme Court on Friday after an overnight stay in Thong Pha Phum prison.

They are required to wear electronic ankle tags to monitor their movements, and are banned from leaving the country.

The court also required them to post 1 million baht each as a surety.

Premchai and co-defendants Yong Dodkruea and Thanee Thummat arrived at the court in Thong Pha Phum district in a Thong Pha Phum prison truck about 9am. They were kept waiting in the detention room at the court until a decision on tjheir bail application was announced in the afternoon.

A prison nurse accompanied Premchai, who has diabetes.

Court turns down Premchai's request to remove EM tracker

KANCHANABURI: Thong Pha Phum Court has rejected a request from construction tycoon Premchai Karnasuta to have his electronic monitoring (EM) bracelet removed.

Premchai asked for the tracker to be taken off his right ankle, claiming that bracelet caused a wound which had become inflamed due to his diabetes.

The court rejected the request, saying that the wound was located on Premchai's left, not right, ankle.

The president of Italian-Thai Development Plc was arrested along with three other people on Feb 4, 2018 at an unauthorised camp in Thungyai Naresuan Wildlife Sanctuary in Thong Pha Phum district.

Authorities raided the camp and found firearms, ammunition and the carcasses of a rare black panther, a kalij pheasant and a barking deer.

The four suspects were charged with illegal possession of wildlife carcasses and other poaching-related offences, which earned Premchai a 16-month jail sentence last year.

His driver, Yong Dodkruea, received a jail term of one year and one month, while his maid, Nathee Riamsaen, was handed a four-month suspended sentence.

Premchai's aide Thanee Thummat was sentenced to three years and five months in jail.

In December last year, Court of Appeal Region 7 increased Premchai's jail term to three years and two months, while his driver's sentence was raised to three years and five months and Thanee's to three years and nine months.

Following the Appeal Court's ruling, they were freed after posting one-million-baht bail, pending an appeal to the Supreme Court.

They were granted bail on condition they wore an EM ankle bracelet and did not travel abroad.

The quartet reported to the court on Jan 9, ahead of the Jan 13 deadline set for them to do so as part of their bail terms.

Premchai's lawyer, Withoon Yaemprai, said they will file an appeal with the Supreme Court on Feb 11.

I am an eater, not a butcher, but I don't care to kill animals. Unfortunately in HH there is not a choice of wild animals food restaurants.
