Divorce Law.
Section 1533 of the Civil and Commercial Code:
Section 1533. Division of Marital Property
Upon divorce, the Sin Somros shall be divided equally between man and woman.
Sin Somros - assets acquired during the marriage regardless of who bought it.

As the registered keeper I’m sure she does.

There is no 'registered keeper' in Thailand. She is the owner as it is in her name.
Registered Keeper - owner, are the same as far as I’m concerned

Sorry, I was just making the comparison. 'Registered keeper' in the UK is not the owner and is not a term in Thailand.

All sounds fair on the Thai side. Could a Thai lady seek a divorce settlement in the UK? (both the farang and Thai national live in Thailand and make occasional visits to the UK.

You can divorce in the UK and will come under UK laws. If divorced in Thailand, The Thai partner would have to make a separate claim regarding assets in the UK. That claim would have to go through the British courts which could be quite expensive. The split on assets in the UK is handled case by case.

HHTel, I think you are correct about a Thai National having to make a separate claim in the UK. I think the Thai National would have to show some connection with the UK such as living there.

Correct. They would also have to show some financial contribution. Although the guidelines are for a 50 - 50 split, each case is judged on merit and if the Thai spouse can't show any contribution
or involvement to life in the UK, then he/she is on a loser.

Given the considerable costs involved with UK lawyers charging around £200ph for the office junior, I imagine around 0.00000001% of thai/farang divorces would be worth going down that route. It would be next to impossible for your average thai to navigate the UK legal system esp from the other side of the planet, with or without a lawyer and fluent english would be an absolute requirement imo.

Robinhood wrote: Mon Aug 21, 2023 7:39 pm Hi,

I'm planning to marry a Thai lady. We have been together for about a year. I don't have any assets in Thailand, but I have a property in the UK and a couple of modest pensions from UK institutions. We both live in Hua Hin.
If the marriage doesn't work out, are my UK assets at risk? From my research it seems only assets acquired in Thailand during the marriage would be at risk. In four or five years I may want to build a house for her in Issan. If we divorced soon after this was completed, would all be lost? I know this board has a wealth of personal experience and I'm interested to hear of any pitfalls should my marriage not work out. Cheers Robin
Having read the posts on this thread, and listened to chaps who have lived in Thailand for years, I would say that co-habitation is safer from a financial point of view.
and for her?
