Being a none smoker someone has just walked passed my house with a ciggy in his mouth do I call the police.

Only if they smoke in your house. If you want to call the police, first, drag the person into your house, then call the police. Don't let them put out the cigarette, you'll need evidence.

The smoking ban in restaurants is not enforced so I can't imagine the home ban will be carried out unless a disgruntled family member makes an incentivized complaint to the police.
