Immigration requirement for lease agreements

Post by Minnie136 »

A friend of mine is staying (FOC) at my property and immigration are asking that he provides a lease agreement in order to get a certificate of residence. I don't normally issue legal documents to friends who are visiting! Any ideas what they want exactly?

Did you notify immigration within 24 hours of arrival, if not oops. If you are not charging then there can be no lease. Have you been into see immigration and explained that he is staying free of charge.

He has a work permit and I'm letting him stay at mine as a friend. He's explained all that to them but they still say they want to see the agreement!

I'm afraid that makes little difference, if you haven't reported the fact formally to immigration, you are committing an offence. Tread carefully. Get him registered at your address before you think about a certificate of residence. Consider telling a white lie and say he's just arrived at your place.

There are many lease agreements on the internet, just download a simple one, edit stating there is no lease fee and submit.

Thanks folks! I've already submitted a TM30 but it was the lease agreement that was worrying me

When friends requested their certificate of residence, it could be a lease agreement or a letter from the property owner. Maybe it's changed, but that was definitely the way around it at that time.

Think very carefully, better check with your friend exactly what he has told immigration to date before deciding on your approach for notification to avoid any 'confusion' so to speak.

The last time I needed a residence certificate I was in a similar situation. The solution was simple: I checked into a cheap hotel for a night (didn't even sleep there), and asked the manager to sign a statement saying that I am currently staying at the hotel. Immigration was happy with this and gave me my cert.

You used to be able to get a letter from the police. A long time ago so don't know if it still works.

Minnie136 has confirmed that the friend's arrival was reported correctly.
