UK Tax Return

Post by Dannie Boy »

Year 2012-13 was the first year I had to complete my UK tax return after giving up work - previously I worked as an expat and my employer provided one of the big 4 tax companies to do it for us.

So I completed my self assessment on line using the proprietary software that one of a number of companies provide. I thought I had done everything ok until I received my 2014-15 tax code and it stated that my code had been reduced because I owed money from the 2012-13 tax year. I tried emailing my query but HMRC are not very user-friendly with emails and eventually I had to resort to phoning them.

What it turned out was that I had incorrectly completed my submission and should have ticked the following box:

"If you are entitled to claim personal allowances as a non-resident on some other basis, or as a dual resident remittance basis user under the terms of certain Double Taxation Agreements (read the notes), put ‘X’ in the box"

By not doing so, they have not given me any personal allowance and hence it has cost me over £1650 in additional tax. All being well, I will be able to submit a revised self assessment and get the correct tax code, but be aware when you are doing your own tax return.

Hi,

I'm working in Hua HIn and have UK non resident status. I'm renting a property out in the UK and so I think I have to do a self assessment for the 2019/20 tax year.
One thing has surprised me, the GOV.UK website states clearly that I cannot do this online! Link below. And says I have to send the assessment in by post. I think this might also mean I have now missed the Oct 31 deadline for postal self assessments and will get a fine. Has anyone else been posting self assessment tax returns to the UK?

You cannot use HMRC’s online services to tell them about your income if you’re non-resident. Instead, you must do one of the following:

fill in a Self Assessment tax return and an SA109 form and send by post"

You can do it on line but not using the HMRC website to submit it. There are many providers out there but for a number of years I’ve been using a company called Andica https://www.andica.com - you use their software and it links automatically to file your return to HMRC - it costs less than £20 and is reasonably straight forward to complete - doing it this way you have until the end of the year to submit it

If you’re a non-resident then you are not supposed to file a tax return using the HMRC website - see attached https://www.gov.uk/tax-uk-income-live-abroad

I wish I had tried that, I’ve been using a third party software provider which although not expensive is just another added step - I guess that if I changed now it would probably get noticed!!

Caller do you pay tax in the UK, if so you do your tax return via the .gov.uk site. If you do not pay tax in the UK you cannot do it on line..

I pay tax in the UK via my pension, but was very much under the impression that if you do not live in the UK, you cannot submit your tax return using the UK tax gateway or whatever they call it

Yes, I do and that is what I have always done. The system improves year by year as well, just taking you to the relevant pages that need completing.

I filed my 2019/20 Self Assessment yesterday. I tried to use the company suggested by Danny Boy but the payment wouldn't process. Helpfully, HMRC list quite a lot of companies whose software you can use so I ended up using ABC.

I didn't try to file direct with GOV.UK as the web site clearly said you can't do this if you are non resident status.

I've also got to admit that I was guessing at a few of the answers near the end. I claimed for interest on a mortgage and I hoping this is still the case in tax law.

If you do not pay tax in the UK and are not even resident there - do still even have to do it? (I know US laws are harsh but not sure about the UK)

It might depend on individual circumstances, but I get a reminder from HMRC every year that I need to complete a self-assessment. It could be because before I retired I had been non-resident for a number of years and my tax affairs had been dealt with by my company’s tax advisers (Deloitte), so I was on their “radar”

Cheers, staying off the radar sounds like a plan!
