I'm sorry, but I'm confused now? FLR has always been available from within the UK as the SV is expiring, especially where the spouse can't go for ILR as they haven't passed the LITUK test or the ESOL thing with Citizenship. Obviously, if they have managed either of these things, ILR is the better op...

Dodgy English schools will be the next growth industry !! They're already all over the place - and quite well known! Used by those claiming visas to the UK and for those here, seeking an exemption to paying Council Tax. As regards ESOL, which is meant to be regulated, a few places are already known...
